PRIVACY & PERSONAL INFORMATION
Privacy, handled with care.
This Privacy Policy explains how Mambodla (Pty) Ltd, trading under the Mambodla Professional Accountants name, collects, uses, stores and discloses personal information through this website, website enquiries and related communications.
01 · Who we are
Who we are and what this policy covers
This website is operated by Mambodla (Pty) Ltd (registration number 2016/241952/07) under the Mambodla Professional Accountants name (“Mambodla”, “we”, “us” or “our”). This policy explains how we collect, use, store and disclose personal information through this website, website enquiries and related communications.
Mambodla is based at 09 Quail Street, Elspark, Germiston, Gauteng, 1418, South Africa. The full address is published in Mambodla’s formal legal and compliance information and is not displayed on the general Contact page.
02 · Information
Personal information we may collect
Depending on how you interact with us, we may process:
- your name, email address and telephone number;
- the service or enquiry category you select, together with the subject and content of your message;
- information you voluntarily include in correspondence or later provide when discussing possible professional services;
- technical request information generated when the website is accessed, such as IP address, browser/device information, requested pages, timestamps and security or diagnostic logs processed by hosting or delivery providers.
Please do not send sensitive records through the public enquiry form.
Tax returns, identity documents, bank statements, payroll records and other sensitive client records should only be provided through a channel agreed with Mambodla for that purpose. Please also do not submit special personal information, such as health, religious or biometric information, or personal information about children through the website.
03 · Purpose
Why we process personal information
We process personal information only for legitimate and lawful purposes, which may include:
- responding to enquiries and communicating with prospective or existing clients;
- taking steps at your request before entering into a professional engagement;
- providing accounting, tax, payroll or business advisory services after an engagement has been accepted;
- maintaining business, professional, security and compliance records;
- protecting our website, systems, clients and legitimate business interests; and
- complying with legal, regulatory, tax, accounting and professional obligations.
Where required, processing may be based on consent, steps connected with a contract or requested service, compliance with a legal obligation, protection of your legitimate interest, or pursuit of the legitimate interests of Mambodla or a third party to whom the information is supplied, as recognised by the Protection of Personal Information Act 4 of 2013 (POPIA).
04 · Providing information
Whether providing information is voluntary
Using the public website does not require you to identify yourself. Providing information through the contact form is voluntary; however, if you do not provide enough contact and enquiry information, we may be unable to respond or assess your request.
Where we later request information because of a legal, regulatory, professional or contractual requirement, we will explain that requirement where reasonably practicable.
05 · Service providers
Contact form and service providers
The website contact form currently uses FormSubmit to transmit enquiries to Mambodla. Form submissions may therefore be processed by FormSubmit for delivery and service operation in accordance with its own terms and privacy practices.
The website is hosted and delivered using Netlify infrastructure. Netlify and its delivery network may process technical request information necessary to serve, secure and operate the website.
The website may request the Poppins typeface from Google Fonts. A visitor’s browser may therefore connect to Google-operated font services to retrieve the stylesheet and font files required for display.
We may also use other professional or technology service providers where reasonably necessary to operate our business, subject to terms requiring them to process personal information only with our authorisation, to treat it as confidential and to maintain appropriate security safeguards, as required by POPIA.
06 · Tax calculator
Your calculator information stays in your browser
The Mambodla Individual Income Tax Calculator performs its calculation in your browser. The taxable income, age band and medical-scheme values entered into the calculator are not submitted to Mambodla by the calculator itself.
If you later choose to contact Mambodla and include tax information in your message, that information will be processed as part of your enquiry.
07 · Sharing
Sharing and disclosure
We do not sell personal information. We may share information with service providers acting for or with us where this is necessary to operate the website, deliver communications or provide an agreed service.
We may also disclose information where required by law, a regulator, a court or other competent authority, or where reasonably necessary to establish, exercise or defend legal rights.
08 · Cross-border processing
Cross-border processing
Some technology providers used by the website, including FormSubmit, Netlify and Google, may process information outside South Africa, including in the United States and other countries where their infrastructure is located.
Mambodla will only transfer personal information outside South Africa where section 72 of POPIA permits it, for example where the recipient is subject to a law, binding corporate rules or a binding agreement that provides an adequate level of protection, where you have consented, or where the transfer is necessary to respond to your request or perform a contract with you.
09 · Retention
How long we retain information
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected or subsequently processed, unless a longer period is required or authorised by law, reasonably required for lawful business or professional purposes, required by contract, or permitted with consent.
When we are no longer authorised to retain information, we will take reasonable steps to delete, destroy or de-identify it as appropriate.
10 · Security
How we protect information
We take reasonable technical and organisational measures intended to protect personal information against loss, unauthorised access, interference, misuse, alteration, disclosure or destruction. No internet transmission or storage system can be guaranteed to be completely secure.
If Mambodla has reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, we will follow the notification obligations that apply under POPIA.
11 · Your rights
Your privacy rights
Subject to applicable law, you may:
- ask whether Mambodla holds personal information about you and request access to it, following the procedure in our PAIA Manual;
- request correction or deletion of personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained, or the destruction or deletion of records that we are no longer authorised to retain, where the law permits;
- object, on reasonable grounds, to processing based on legitimate interests, and object at any time to processing for direct marketing;
- withdraw consent where processing is based on consent, without affecting processing that was lawful before withdrawal; and
- lodge a complaint with the Information Regulator (South Africa).
We may take reasonable steps to verify your identity before responding to a request concerning personal information.
12 · Direct marketing
Direct marketing
Mambodla does not currently use the website contact form as an automatic subscription to unrelated marketing communications.
If we introduce electronic direct marketing, we will only send it to you if you have consented or if you are an existing client and the communication relates to our own similar services, and each communication will include a simple way to unsubscribe.
13 · Cookies & third parties
Cookies, analytics and third-party links
At the date of this policy, Mambodla does not intentionally deploy advertising or behavioural-tracking analytics on this website. Hosting, security, font-delivery or other third-party services may still process standard technical request data required to provide their services.
The website contains links to third-party platforms such as Facebook, X, LinkedIn and WhatsApp. If you follow those links, the third party’s own terms and privacy practices apply.
14 · Changes
Changes to this policy
We may update this policy when our website, services, service providers, processing practices or legal obligations change. The latest published version will state its effective or last-updated date.
